Terms of Service

1. Acceptance of Terms

By accessing and using CloakBioGuard (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. CloakBioGuard is a product of WellnessLabs LLC.

2. Eligibility and Accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, to use paid features, including the removal service. You are responsible for the accuracy of account information and for maintaining control of your sign-in credentials.

3. Description of Service

CloakBioGuard offers (a) tools to scan images and to modify images to reduce facial-recognition matching risk using adversarial image-protection methods, and (b) a done-for-you removal service in which, with your authorization, we submit opt-out / removal requests on your behalf to third-party face-search engines.

4. Removal Service: Authorization, Scope, and Limits

If you purchase the removal service:

• Authorization. You authorize us to submit opt-out and removal requests on your behalf using the face photo and government ID you provide, and you represent that the photo and ID are your own and that you are at least 18.
• Scope. We submit removals to a fixed, named set of face-search engines — currently PimEyes and FaceCheck.ID. We do not remove you from every website or engine, and we do not delete the original photos from the sites that host them.
• No guarantee of outcome. Each engine independently decides whether and when to honor an opt-out. We cannot guarantee acceptance, processing times, or that you will be removed.
• Not permanent. Face-search engines re-index over time, so new photos of you may be added after a removal. A completed removal reflects what was indexed at the time of the request, not future indexing.

5. User Responsibilities

You are responsible for content you upload. You represent that you have the right to upload and submit the images and ID you provide. You agree not to use the Service for unlawful activity, rights infringement, abuse, impersonation of another person, or attempts to circumvent legal identity-verification systems.

6. Accounts, Sign-In, and Credits

Paid usage of the scan and protection tools requires account sign-in. Credits are linked to your account and are not guaranteed to transfer across different accounts. You are responsible for maintaining access to your account credentials.

7. Fees and Refunds

Payments are processed by Stripe, and pricing may change at any time. For credit packages (scan and protection), credits are non-refundable after use except where required by law.

For the removal service, because the work is performed on your behalf and involves submissions to third parties, fees are non-refundable once we have begun submitting your removal requests. If you have not yet provided the photo and ID needed to start, or before we begin submitting, you may request a refund by contacting us. We do not refund based on a third-party engine's decision to reject, delay, or later re-index your images, as those outcomes are outside our control.

8. Protection Tools: Effectiveness and Limits

Facial recognition technology evolves continuously. Image-protection output is designed to reduce matching risk based on known techniques at the time of processing, but may degrade or fail against newer or updated recognition systems. Protection results are not permanent guarantees, and effectiveness against any specific third-party system is not warranted.

9. Intellectual Property and License

You retain ownership of your uploaded content. You grant us a limited, revocable, non-exclusive license to process and, for the removal service, submit your content solely to provide and secure the Service. Except for this limited license, no ownership rights in your content are transferred to us.

10. Privacy and Data Handling

Use of the Service is also governed by our Privacy Policy, which explains how we handle your face photo and ID for the removal service.

11. Service Availability and Changes

We may modify, suspend, or discontinue features at any time. We do not guarantee uninterrupted availability or error-free operation.

12. Suspension and Termination

We may suspend or terminate access if we reasonably believe you violated these Terms, created risk for other users, or exposed the Service to legal or security harm.

13. Disclaimers and Limitation of Liability

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, WellnessLabs LLC disclaims warranties and is not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Service, including outcomes determined by third-party face-search engines.

14. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles.

15. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after updates become effective constitutes acceptance of the updated Terms.
