Terms of Service

1. Acceptance of Terms

By accessing and using CloakBioGuard (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. CloakBioGuard is a product of WellnessLabs LLC.

2. Eligibility and Accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, to use paid features. You are responsible for the accuracy of account information and for maintaining control of your sign-in credentials.

3. Description of Service

The Service provides tools to scan and modify digital images to reduce facial-recognition matching risk using adversarial image-protection methods.

4. User Responsibilities

You are responsible for content you upload. You represent that you have the right to upload and modify submitted images. You agree not to use the Service for unlawful activity, rights infringement, abuse, or attempts to circumvent legal identity verification systems.

5. Accounts, Sign-In, and Credits

Paid usage requires account sign-in. Credits are linked to your account and are not guaranteed to transfer across different accounts. You are responsible for maintaining access to your account credentials.

Payments are processed by Stripe. We may offer single-photo and bundle credit packages. Except where required by law, credits are non-refundable after use, and pricing may change at any time.

6. Protection Effectiveness and Limits

Facial recognition technology evolves continuously. Protection output is designed to reduce matching risk based on known techniques at the time of processing, but may degrade over time. Protection results are not permanent guarantees.

You should periodically re-evaluate and, where needed, re-protect images, especially when facial-recognition methods or your published image set changes.

7. Intellectual Property and License

You retain ownership of your uploaded content. You grant us a limited, revocable, non-exclusive license to process submitted content solely to provide and secure the Service. Except for this limited license, no ownership rights in your content are transferred to us.

8. Privacy and Data Handling

Use of the Service is also governed by our Privacy Policy.

9. Service Availability and Changes

We may modify, suspend, or discontinue features at any time. We do not guarantee uninterrupted availability or error-free operation.

10. Suspension and Termination

We may suspend or terminate access if we reasonably believe you violated these Terms, created risk for other users, or exposed the Service to legal or security harm.

11. Disclaimers and Limitation of Liability

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, WellnessLabs LLC disclaims warranties and is not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Service.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after updates become effective constitutes acceptance of the updated Terms.
